Terms

1. Rental Payment Terms.
City Linen International requires a twenty five (25%) non-refundable deposit with any major credit card when the linens are ordered.  This deposit secures your linen will ship on the requested date.  Reservations should be ordered at least two weeks before your event date.  The balance of the order (75%) will be charged one week before your linen ships, along with the two way shipping charge. 

2. Cancellations and Order Changes.
Any cancellation before the final payment shall incur a 25% cancellation fee (the non-refundable deposit).  Any cancellation within one week of the requested shipment date shall an additional 25% restocking fee, as these items will not be able to be rented to other customers.

3. Last Minutes Orders.
Any reservation change or new order placed less than 2 weeks prior to the requested shipment date will be subject to a rush order fee.  Order changes include increases, decreases, or substitutions.   Requested inventory for order changes are not guaranteed.

4. Purchased Linen.
All purchases are final (no returns or credits).  Please make sure you have approved any samples before ordering.

5. Dye Lots.
Dye lots (colors of the linen) vary for several reasons.  Linens are purchased from different suppliers at different times.  Also, some pieces have been laundered more than others, leading to a fading of color.  We do make every attempt to make sure all colors match before they are sent out.

6. Physical Condition of Linens.
You acknowledge that it is your responsibility to return the linens in the same condition that you received them, except for normal soiling. Normal soiling is food, beverages, and other consumable stains. It does not include wax, ink, holes, and/or other unusual damage. Linens are expected to be free of loose items before returning. Upon receipt of all linen, it is your responsibility to inspect them and inform us of any damages on the delivery date. Linens that are returned damaged are assumed to have to be damaged by the customer and will be charged according to this agreement.

7. Responsibility of Linens.
You are responsible for the linens from the time they are delivered to you until they are accepted back to our warehouse.  You are responsible for counting and inspecting the linen when it is delivered.  If you don’t inspect and count the linen the day it’s delivered, you surrender the right to claim the linen is not missing upon its return.  YOU WILL BE CHARGE FOR ANY LINEN THAT IS MISSING, LOST, STOLEN, OR DAMAGED REGARDLESS OF FAULT.  Rental credit cards will be stored on our secure server in the event any linens are lost, damaged, or returned past their due date.

8. Returning Linens.
Linens rented are due back on the fourth (4th) business day after the “usage date” (day of your event).  For example, Linen rented for a Saturday wedding would be due back on the following Thursday.  Any linen not returned by the fifth (5th) business day will be charged an additional rental fee.  Please make sure the sashes (bows) are returned untied.  If more than 4 bows are returned with knots, a service charge will be billed at a rate of $.40 per knot.

9. Charges, Fees, Payments and Collection Costs.
You acknowledge you are responsible for all of the linen shipped to you.  You agree that any item that is missing or damaged will be automatically charged to your credit card at the purchase rates listed on our website.  Any item not listed on our website will be billed at our two and one half times (2.5x) the rental prices on your rental invoice.  You acknowledge that you are responsible for all collection costs including collection fees, attorney fees, court costs, and any other costs incurred to collect the fees due as explained in this agreement.   

10. Governing Law.  
This Agreement has been made in and will be construed and enforced in accordance with the laws of the State of Florida, as applied to agreements entered into and completely performed in Florida. Any action to enforce this Agreement, in law or seeking equitable relief, will be brought in a court of competent jurisdiction presiding in Broward County, Florida, and all parties to this Agreement expressly agree to be subject to the jurisdiction of such courts. This Service is controlled and operated by City Linen International from its offices within the United States.

11. Other Property.
We are not responsible for any property shipped to us that not ours.  We will ship any items back to you at your expense, but ultimately it is not our responsibility.  We are not subject to any charges incurred to you as a result of these said items.

12. Indemnification.
You agree to defend, indemnify, and hold harmless City Linen International and its affiliates, all of their employees, agents, directors, officers, proprietors, partners, representatives, shareholders, servants, attorneys, predecessors, successors, and assigns, and the Users from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and litigation expenses), relating to or arising out of or in connection with any claim, suit, action, or other proceeding brought against City Linen International or such party, to the extent that such claim, suit, action or other proceeding is based on or arises from: your provision of services to any third party, regardless of whether or not they are Users using the Service; The provisions of this Section shall survive the termination of this Agreement or your termination or suspension from the Service. City Linen International is under no contract with our customers other than what is stated in this agreement.  We hold the right to refuse, deny and/or hold any orders resulting from lack of payment.   City Linen International is not responsible for the fees charged by any other company.

13. UPS Shipments and Returns.
All orders must be returned by the due date on the front of your invoice.  The due date is also listed in the shipping pouch.  Any linen not returned by the due date will be charged an additional one-time rental fee.  All product not returned after the second rental period will be billed a replacement fee (2.5 times the rental fee).  You acknowledge by approving this agreement that all penalty rental fees or replacement fees will be charged to the credit card used to reserve your linens.
